This Acceptable Use Policy (“Policy”) governs the use of Raven, a messaging and communication platform provided by Utilitay (“Utilitay”, “Raven”, “we”, “us”, or “our”).

This Policy applies to all individuals, schools, businesses, NGOs, institutions, companies, and other organisations (“Users”, “Customers”, or “you”) that access or use Raven.

Raven uses third-party communication infrastructure, including the Ponitor API for SMS messaging. Accordingly, use of Raven must comply with this Policy, applicable laws, and the applicable policies and requirements of Ponitor, telecommunications operators, messaging platforms, and other communication networks used to provide the service.

Where Raven is used by, or on behalf of, a political party, political coalition, candidate committee, or affiliated membership organisation, use of Raven is additionally governed by the Raven Political Organisations Schedule, which forms part of this Policy and is summarised in Section 13 below.

By creating an account, clicking “I Agree”, or using Raven, you acknowledge that you have read, understood, and agree to comply with this policy. If you use Raven on behalf of an organisation, you represent that you are authorised to accept this policy on its behalf.

1.Permitted Use

Raven may be used to send legitimate and authorised communications to recipients. These may include transactional notifications, school and educational notices, attendance notifications, payment and fee reminders, appointment reminders, organisational announcements, customer-service communications, operational alerts, political party and membership-organisation administrative communications (subject to Section 13 and the Political Organisations Schedule), and marketing or promotional messages where the recipient has provided any consent required by applicable law or provider policy.

Users are responsible for ensuring that their use of Raven and the content of their messages are lawful, accurate, appropriate, and authorised.

2.Consent and Recipient Authorisation

Before sending messages through Raven, you must obtain clear and verifiable consent from recipients whenever consent is required.

You are responsible for maintaining appropriate evidence of consent. You must not purchase, scrape, harvest, obtain unlawfully, or otherwise use contact lists where recipients have not authorized the applicable communications.

The fact that you possess a person’s telephone number does not, by itself, give you permission to send unsolicited marketing or promotional messages.

3.Sender Identification

Messages must accurately identify the person, business, school, institution, or organization responsible for the communication.

You must not impersonate another person or organisation, falsify sender information, or deliberately mislead recipients about the source or purpose of a message.

4.Opt-Out and Unsubscribe Requests

Where required by applicable law, platform rules, or messaging-provider requirements, messages must provide recipients with an appropriate way to opt out of future communications.

Users must respect valid unsubscribe, STOP, opt-out, or similar requests and must not intentionally continue sending messages to recipients who have withdrawn the relevant consent.

Raven may implement technical measures to help process or enforce opt-out requests.

5.Spam and Unsolicited Messaging

You may not use Raven to send bulk messages without proper recipient consent; unsolicited marketing or promotional communications; repeated unwanted messages; message flooding; abusive messaging campaigns; or messages deliberately designed to evade spam-detection or messaging-provider controls.

6.Prohibited Content and Activities

Raven must not be used to engage in, promote, facilitate, or distribute illegal, fraudulent, harmful, deceptive, or abusive activities.

6.1Gambling and Betting

Raven may not be used to send messages relating to gambling, betting, lotteries, games of chance, betting platforms, betting odds, betting tips, or communications facilitating participation in gambling-related services.

6.2Fraud and Deceptive Practices

You may not use Raven for phishing, scams, fraudulent schemes, impersonation, deceptive marketing, or requests for sensitive personal or financial information under false pretenses.

6.3Illegal Content

You may not use Raven to send content that violates applicable laws or regulations or promotes illegal goods, services, transactions, or activities.

6.4Harmful or Abusive Content

Raven may not be used to distribute harassment, threats, hate speech, or content that exploits, harms, or endangers individuals.

7.Platform and Network Integrity

You must not use Raven to interfere with or disrupt Raven, Ponitor, telecommunications networks, or other connected services; circumvent security measures, message limits, access restrictions, or technical controls; attempt unauthorized access to Raven or connected systems; introduce malware or malicious code; conduct unauthorized automated activity against Raven infrastructure; abuse APIs or messaging infrastructure; or use Raven in a manner that could damage, disable, overload, or impair Utilitay, Ponitor, or third-party infrastructure.

8.Third-Party Messaging Requirements

Raven’s SMS functionality uses the Ponitor API.

Messages sent through Raven may therefore pass through Ponitor, telecommunications operators, mobile networks, and other third-party communication infrastructure.

Users must comply with applicable policies and technical requirements imposed by those providers. Where a third-party provider imposes a mandatory requirement or restriction necessary for Raven to continue providing messaging services, Utilitay may implement that requirement within Raven.

9.Customer Responsibility for Content

You are responsible for all messages, recipient information, contact lists, campaigns, and other content submitted through your Raven account.

Utilitay does not assume responsibility for the accuracy or legality of Customer-generated messages merely because Raven technically processes or delivers them.

You must ensure that you have the necessary rights, permissions, and authority to use any personal information, trademarks, copyrighted material, or other content included in your communications.

10.Account Security

Users are responsible for maintaining the confidentiality of their Raven login credentials and for activity conducted through their accounts.

You must promptly notify Utilitay if you reasonably believe your account has been compromised, accessed without authorization, or used to send unauthorized messages.

You must not sell, transfer, share, or provide account access in a manner that circumvents Raven’s security or account controls.

11.Monitoring and Enforcement

Utilitay may take reasonable measures to protect Raven, its users, recipients, Ponitor, telecommunications providers, and other connected networks.

Where Utilitay reasonably suspects a violation of this Policy, it may investigate the relevant activity and, where appropriate, block or reject messages, restrict particular messaging functions, require corrective action, temporarily suspend an account, terminate access for serious or repeated violations, or cooperate with competent authorities where required by applicable law.

Where reasonably practicable, Utilitay will provide notice of a violation and an opportunity to correct it. However, immediate action may be taken where necessary to prevent fraud, unlawful conduct, security threats, network disruption, significant harm, or suspension of Utilitay’s access to an essential messaging provider.

12.Service Provider Restrictions

Raven’s ability to deliver SMS and other communications depends partly on third-party providers.

Utilitay may therefore block, delay, restrict, or decline transmission of a message where necessary to comply with applicable law, this Policy, Ponitor requirements, telecom-operator requirements, network restrictions, or other applicable messaging-platform rules.

A message being accepted by Raven does not guarantee that the recipient’s network or another third-party provider will ultimately deliver it.

13.Political Organisations

Use of Raven by a political party, political coalition, candidate committee, or affiliated membership organisation (each, a “Political Organisation”) is subject to this Section and to the Raven Political Organisations Schedule, which is incorporated into this Policy by reference. Where this Section or the Schedule conflicts with another provision of this Policy specifically with respect to a Political Organisation’s use of Raven, this Section and the Schedule control.

13.1Administrative Communications Only

A Political Organisation may use Raven to send Administrative Communications — internal, organisational messages to its own verified officials, members, delegates, or staff, such as meeting notices, convention or event reminders, training notifications, membership-dues reminders, and emergency schedule changes.

13.2Campaign/Electoral Communications Excluded by Default

Raven may not be used to send Campaign/Electoral Communications — messaging intended to influence public opinion, solicit votes, promote a candidate or party to the electorate, encourage voter turnout, or solicit public donations — unless the Political Organisation has obtained separate written authorisation from Utilitay. Any such authorisation remains subject to confirmation that Ponitor, applicable telecommunications operators, and any relevant messaging platform permit such use.

13.3Onboarding, Compliance, and Suspension

Political Organisations are subject to additional onboarding requirements, recipient-consent warranties, sender-identification and content-review conditions, and compliance obligations under applicable election law, and Utilitay may suspend or restrict a Political Organisation’s use of Raven where reasonably necessary for legal, regulatory, or upstream-provider compliance, all as further described in the Political Organisations Schedule.

14.Changes to This Policy

Utilitay may update this Acceptable Use Policy to reflect changes to Raven, applicable law, security requirements, or the policies and technical requirements of Ponitor and other messaging providers.

The updated Policy will be published with a revised “Last Updated” date. Where a change materially affects Users’ rights or obligations, Utilitay may provide additional notice or require Users to accept the updated Policy before continuing to use Raven.

15.Relationship With Other Raven Policies

This Acceptable Use Policy forms part of the terms governing access to Raven and should be read together with Raven’s Terms of Service, the Raven Political Organisations Schedule (where applicable), and Privacy & Cookie Policy.

If you do not agree with this Policy, you must not use Raven.
